1. What these terms are

These terms govern the use of the TRAMA Cross Stitch app and its related services, provided by Jorge Morales López, tax ID (NIF) 77535351M, with address at Calle Cristóbal Colón, 48, 1º A, 41710 Utrera (Seville), Spain (“we”, “us” or “TRAMA”).

By creating an account or using the app you accept these terms and our privacy policy. If you do not agree with them, please do not use the service.

2. Who can use TRAMA

You must be at least 18 years old and able to enter into a binding contract. When you register you confirm that both are true.

3. Your account

You are responsible for the accuracy of the details you provide, for keeping your password safe and for the activity that happens under your account. Let us know as soon as you suspect unauthorised access.

You can delete your account at any time from the app, under Profile → Delete account. It is immediate and cannot be undone: your account, your content and your published projects are erased. If you cannot sign in, there is an alternative route in Delete your account.

Deleting your account does not cancel your TRAMA Pro subscription, if you have one: it is billed by the store, and you must cancel it there before deleting your account (section 12).

We may also suspend or close your account if you breach these terms seriously or repeatedly. We will tell you when we do, unless the seriousness of the case or a legal obligation prevents it.

4. Licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable and limited licence to install and use TRAMA on devices you control, for personal and non-commercial purposes.

You may not: copy, modify, decompile or reverse engineer the app; resell, rent or redistribute it; extract its data by automated means; circumvent its technical limitations; or use it to build a competing product.

The software, the brand, the design, the internal catalogue, the symbols and the image-to-pattern conversion algorithms belong to their owner and are not transferred to you.

5. Your content is yours

Everything you create or upload — patterns, images, photos, journal entries, comments — remains yours. We claim no ownership of it.

So that we can provide the service, you grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, copy and display that content, solely to make TRAMA work for you. If you publish a project, that licence extends to showing it to other users inside the app, to the extent and with the visibility you have chosen, and to generating the thumbnails and previews needed for that.

The licence ends when you delete the content, except for technical backups that are purged over time and copies that other people legitimately created before deletion.

When you publish content you warrant that you hold the rights needed to do so.

6. Other people’s patterns

This part matters, because TRAMA lets you import patterns you have bought.

You may import a third-party pattern if you have the right to use it. Most patterns sold in shops are licensed for personal use.
Importing one into TRAMA to stitch it yourself is personal use. Publishing it, sharing it, selling it or allowing other people to make editable copies of it is not.
You should only publish a project, or enable editable copies, for patterns you created yourself or have the right to redistribute.
We neither ask for nor store the pattern PDFs you import, and we do not access their content.

Publishing content that infringes third-party rights is a serious breach of these terms.

7. Notice of infringement

If you are a rights holder and believe that content published on TRAMA infringes your rights, write to us at hola@tramastitch.com including:

Identification of the work or right concerned.
A link to, or precise identification of, the content you consider infringing.
Your contact details.
A statement that you are acting in good faith and that the information is accurate.
Your signature, physical or electronic, or evidence that you act on behalf of the rights holder.

We will review the notice diligently and, where appropriate, remove or block the content, telling whoever published it why and how they can appeal.

Repeat infringers. We will close the accounts of people who repeatedly infringe third-party rights.

8. AI-generated images

TRAMA includes an assistant that generates images from a theme or from a text you write, using an external artificial-intelligence provider.

You are responsible for what you ask for. Do not generate illegal or offensive content, or content that imitates real works or people in a way that infringes third-party rights.
We do not guarantee that a generated image is original, nor that its commercial use is free from claims. Check that yourself before using it commercially.
The AI provider applies its own terms, and the text you write is sent to it to generate the image.
AI systems can produce unexpected or inaccurate results. They are provided “as is”.

9. Community rules and moderation

In the social parts of TRAMA — published projects, comments, profiles, Stitch-Alongs and their posts — we do not allow illegal content, harassment, hate speech, spam, impersonation, sexually explicit content, or material that infringes third-party rights. There is zero tolerance for this content and for those who post it.

Filter. Text that is made public goes through an automatic filter of offensive words, and anything that does not pass is not published. No filter is perfect: that is why reporting and blocking exist as well.

How to report. Anyone can report a project, a comment, a profile, a Stitch-Along or a post from within the app, with a couple of taps. You can also write to us at hola@tramastitch.com.

Blocking. You can block another person from their profile or when you report something they published. From that moment neither of you sees the other’s content, and the blocked person cannot comment on, like or save your projects. You can undo it under Profile → Blocked users.

What we do. Every report reaches us immediately and we review it as soon as possible, aiming to do so within 24 hours. If the content breaches these rules we remove it, and we may restrict or close the account of whoever published it. When we take action on your content we will explain why and how to appeal, unless a legal obligation prevents it.

Appeals. If you disagree with a moderation decision, you can appeal by writing to hola@tramastitch.com within six months. We will review the case again, with human involvement.

10. The PDF importer, honestly

The importer reconstructs patterns from vector PDFs. We cannot guarantee that any given PDF will import correctly: every program and every shop exports differently, and scanned PDFs or PDFs made of photographs are not imported automatically.

If something fails, the app can prepare a technical report about the file — never the pattern — for us to review. We work on improving it continuously, but its result is offered “as is”, with no guarantee of success for a particular file.

11. Early-stage service

TRAMA is evolving constantly. Some features may be identified as experimental or in testing: they are offered with no guarantee of continuity, they can change and they can be withdrawn.

12. TRAMA Pro: free trial and subscription

What it includes

TRAMA Pro gives you access to every feature of the app: importing patterns (PDF, files from other programs, and images), Follow Along, the editor and Studio, the exports (PDF, project book and time-lapse), the journal, the inventory, and the community features, including Stitch-Alongs.

AI image generation is not included in TRAMA Pro. When it becomes available it will have its own price, which you will see before using it.

Free trial

When you create your account you start a free trial with all features. The app tells you when it ends. While TRAMA is in beta, the trial may be longer than usual.

The trial does not ask for any payment method and does not turn itself into a subscription: when it ends you are not charged anything. From then on you can still sign in and view your projects. To create, import, stitch with Follow Along, edit, export, publish, or use the journal, the inventory and Stitch-Alongs, you need to subscribe.

Plans and prices

Monthly: €4.99 per month.
Annual: €39.99 per year.

Those are the prices in Spain, VAT included. In other countries the store shows you the price in your currency before you pay. The price that applies is always the one you see in the app at the time of purchase.

Purchase, renewal and cancellation

The purchase is made and charged by the store you downloaded the app from (App Store or Google Play), using the account and payment method you have there. We never see or store your card details.
The subscription renews automatically at the end of each period, at the price then in force, until you cancel it.
You can cancel at any time, in the store:
- App Store: Settings → your name → Subscriptions → the TRAMA subscription → Cancel subscription.
- Google Play: at play.google.com/store/account/subscriptions, or from the Play Store app, in the subscriptions section of your profile.
- Also from the app, under Profile → Manage subscription.
After cancelling you keep TRAMA Pro until the end of the period you have already paid for.
Uninstalling the app or deleting your account does not cancel the subscription.
If you already have TRAMA Pro on your store account and it does not appear in the app, use Restore purchases under Profile.

Price changes

If we raise the price, the change does not affect the period you have already paid for. The store will notify you before it applies and you will be able to cancel free of charge before that date. Where the store’s rules require it, you will be asked to accept the new price; if you do not accept it, the subscription will end at the end of the current period.

Refunds and right of withdrawal

As a consumer you have 14 calendar days from purchase to withdraw from the subscription without giving any reason. Since the purchase is charged by the store, withdrawal and refunds are requested there, in accordance with its terms and with the law:

App Store: from your Apple account, in your purchase history, selecting the order.
Google Play: from your order history at play.google.com, choosing the order and the option to report a problem. Google states that, more than 48 hours after the purchase, you can ask us instead.

If you have any problem with a charge, write to us at hola@tramastitch.com and we will help you sort it out.

None of the above limits the rights granted to you by consumer law, including the right of withdrawal and your rights if the service does not work as described.

13. Availability of the service

We do our best to keep TRAMA available, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend or withdraw features; if a change affects you significantly, we will give you reasonable notice.

Your content is backed up in the cloud while you are signed in, but that backup does not replace your own precautions: export whatever matters to you.

14. Warranties and liability

The service is provided “as is” and “as available”. To the extent permitted by law, we give no implied warranties of fitness for a particular purpose or of freedom from errors.

To the extent permitted by law, we are not liable for indirect damages, loss of profit, loss of data, or damage arising from misuse of the service, from content published by other users, or from causes beyond our reasonable control.

Nothing in these terms limits or excludes our liability for wilful misconduct, gross negligence, personal injury, or any other liability that cannot lawfully be excluded. If you are acting as a consumer, you keep in full the rights granted to you by consumer law, which prevail over any clause in this document.

15. Indemnity

If your content or your use of the service breaches these terms or infringes third-party rights, and that gives rise to a claim against us, you will be liable for the resulting reasonable damages, costs and expenses, including legal defence costs.

This obligation does not apply to the extent the claim results from our own breach, and is without prejudice to any rights you have as a consumer.

16. Changes to these terms

We may update these terms. If a change is significant we will notify you inside the app with reasonable notice before it takes effect, and you may stop using the service and delete your account if you do not accept it.

17. Governing law and disputes

These terms are governed by Spanish law. If you are acting as a consumer, you may bring proceedings in the courts of your place of residence, and you keep the protection given to you by the mandatory rules of the country where you live.

We are not signed up to any alternative consumer dispute resolution body. If you have a complaint, write to us first at hola@tramastitch.com and we will try to resolve it. If we cannot, you can also turn to the consumer services of your region or country.

18. General provisions

Severability. If a clause is held invalid, the rest remains in force and will be replaced by a valid one of equivalent effect.
Assignment. You may not assign your position under this contract. We may assign ours in the event of a restructuring or sale of the business, without reducing your rights.
Entire agreement. These terms and the privacy policy are the entire agreement between you and us regarding the use of TRAMA.
Waiver. If we do not exercise a right at a given time, that does not mean we waive it.
Force majeure. We are not liable for failures caused by events beyond our reasonable control.

19. Third-party trademarks

DMC is a registered trademark of Dollfus-Mieg & Compagnie. TRAMA uses DMC codes as a colour reference so that you can buy the right thread, but it is not affiliated with, sponsored by or endorsed by DMC.

The names of other programs, shops or formats that appear in the app or on this website — Etsy, Pattern Keeper, PCStitch, MacStitch, WinStitch, FlossCross and similar — belong to their owners and are mentioned solely to describe which files the importer works with.

20. Store-specific terms

If you downloaded TRAMA from the App Store, the following also applies, as required by Apple:

This agreement is concluded solely between you and us, not with Apple. We, and not Apple, are responsible for the app and its content.
The licence to use the app is limited to Apple devices that you own or control, in accordance with the Usage Rules of the App Store Terms of Service.
Apple has no obligation whatsoever to provide maintenance or support for the app.
If the app fails to conform to any applicable warranty, you may notify Apple, which may refund the purchase price. To the maximum extent permitted by law, Apple will have no other warranty obligation.
We, and not Apple, are responsible for addressing claims relating to the app: product liability, regulatory non-compliance and consumer claims.
We, and not Apple, will be responsible for the investigation and resolution of any third-party claim of intellectual-property infringement relating to the app.
You represent that you are not located in a country subject to a U.S. Government embargo and that you are not listed on any U.S. Government list of restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

If you downloaded TRAMA from Google Play, the Google Play Terms of Service also apply, and purchases are handled in accordance with its payment and refund policies.
